"A California Appellate court in San Francisco said today that it will not issue an injunction banning construction at the site of proposed development near UC Berkeley's Memorial Stadium.
The decision by the three-judge panel allows the campus to begin the construction it has been seeking to begin since December 2006."So while the plaintiffs will try and ask for an emergency injunction from the California Supreme Court tomorrow, that looks to be all but unlikely, considering the plaintiffs have so resolutely gotten their asses kicked in nearly every phase of this legal process.
Long story short: The trees are coming down. The University hasn't announced when they will begin "escorting" the tree-sitters down and beginning construction, but the good news is that they can do it whenever the hell they please.
